1. Company Information

SellyIndex is a trading name of CLICKBAZAAR LTD, a company registered in England and Wales.

2. Acceptance of Terms

By accessing, registering for, subscribing to, or using SellyIndex ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you must discontinue use of the Service immediately.

3. Purpose of the Service

SellyIndex is a Software-as-a-Service (SaaS) platform that provides marketplace research tools, statistical estimates, product intelligence, sales analysis, profit calculations, and related insights based on publicly available marketplace information.

All data, metrics, projections, opportunity scores, and profit estimates are provided for informational purposes only. They represent software-based calculations and estimates and should not be interpreted as guarantees of future performance, profitability, sales volume, or business success.

Users remain solely responsible for their sourcing, purchasing, inventory, pricing, and business decisions.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.

You agree not to:

• Share account access with unauthorized third parties.
• Resell, sublicense, or redistribute access to the Service.
• Attempt to reverse engineer, copy, reproduce, or extract proprietary algorithms, scoring systems, or platform functionality.
• Use automated tools, bots, scripts, or scraping systems to access the platform without explicit authorization.
• Interfere with the security, availability, or integrity of the Service.

5. Subscription Plans, Billing, and Cancellation

Paid subscriptions are billed in advance through Stripe and renew automatically at the end of each billing cycle unless cancelled before the renewal date.

• Subscription features and usage limits are determined by the plan selected by the customer.
• Users may cancel their subscription at any time through their account settings.
• Cancellation prevents future renewals but does not automatically entitle users to refunds for completed billing periods.
• We reserve the right to modify pricing, features, or plan limits with reasonable notice.

6. Fair Use Policy

To maintain platform stability and service quality for all customers, we may monitor usage patterns and apply reasonable usage limits where necessary.

Excessive automated querying, abuse of unlimited plans, system stress testing, scraping activities, or attempts to bypass usage controls may result in temporary restrictions, suspension, or termination of access.

7. Intellectual Property

All software, branding, content, databases, analytical methodologies, scoring systems, visual assets, and platform functionality remain the exclusive property of CLICKBAZAAR LTD or its licensors.

Nothing in these Terms grants ownership rights to users beyond the limited right to access and use the Service according to their subscription plan.

8. Limitation of Liability

To the maximum extent permitted by law, CLICKBAZAAR LTD and SellyIndex shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, or data.

We are not responsible for marketplace policy changes, third-party data inaccuracies, eBay account actions, inventory losses, sourcing decisions, or business outcomes resulting from use of the Service.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, abuse platform resources, engage in fraudulent activity, or create security risks for the Service or other users.

10. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Continued use of the Service after such changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
